Terms & Conditions

These terms and Conditions and your use of our Website are governed by English Law and you agree to submit to the non-exclusive jurisdiction of the English courts. This does not affect your statutory rights.

This Website and our terms and conditions are for use within the United Kingdom and under UK law. We are happy to consider requests for products and services from outside the UK; we give no warranty, express or implied that the use of this website or the placing of any order through the website from outside the UK complies with any applicable non-UK laws or regulations. Consequently any products or promotions not permitted under your local law are not offered to you.

By placing an order with us you will be deemed to have read, understood and agreed to these Terms and Conditions.

 

Orders

When you place an order, we will require your name, e-mail address, credit / debit card number and card expiry date. Without this information we will not be able to process your request or notify you of acceptance of your order.

A contact telephone number is also required so that we may reach you if there is a problem with your order, or if your order requires a delivery quote. We may, unless you advise us otherwise, pass this information to our couriers or other agents in case they need to contact you to arrange the processing or delivery of your order.

As part of our efforts to ensure that you are aware of the latest developments and offers, we may also use this information to advise you of new products, special offers or changes to our site. If you would rather not receive this information, please send an email to enquiries@wheredidyoufindthat.com.

Once your order has been accepted processed and dispatched, the completion of the contract between wheredidyoufindthat.com and yourself takes place.

If we cannot fulfil any obligations due to the following reasons:

The product you ordered being unavailable from stock

Our inability to obtain authorisation for your payment

The identification of a pricing or product description error

Customers who fail to reach any order criteria set out in the Terms & Conditions

or if there are any other problems with your order you will be contacted by one of our Customer Services Representatives either by email or by phone.

We reserve the right to reject any offer of purchase by you at any time. We will not be liable to you or any third party by reason of our withdrawing any product from this Website whether or not that product has been sold; removing or editing any materials or content of the website; refusing to process a transaction or unwinding or suspending any transaction after processing has begun.

We will take all reasonable care, in so far as it is in our power to do so, to keep the details of your order and payment secure but, in the absence of negligence on our part, we cannot be held liable for any loss you may suffer if a third party procures unauthorised access to any data you provide when accessing or ordering from the Website.

 

Contract Cancellation

Please note that you are entitled to cancel this contract if you so wish, provided you exercise your right no longer than eight working days after the day on which you receive the products. If you wish to exercise your right to cancel this contract prior to order dispatch, please contact our customer services department on orders@wheredidyoufindthat.com. If your order has already been dispatched please follow the procedure set out in Returns Policy.

 

Product Pricing & Descriptions

All prices published are in pounds sterling and are inclusive of European Union sales tax at the prevailing rate. Each product purchased is sold subject to its Product Description. We will take all reasonable care to ensure that all details, descriptions, sizes and prices of products appearing on the website are correct at the time when the relevant information was entered onto the system. Although we aim to keep the website as up to date as possible, the information, including Product Descriptions, appearing on this website at a particular time may not always reflect the position at the exact moment you place an order. The stock status of your order will be notified to you on your order confirmation.

 

Sale Item Disclaimer

We have very limited stock of our sale items, and do not take back orders on any of these items. Due to the fact our stock levels are updated once every 24 hours a product may sell out during time you have placed your order and when we try to fulfil it. If this does happen we will contact you within 3 days with an alternative item or refund your money.

 

Promotional Code Disclaimer

You can use published promotional codes through our orderline and website only and not in conjunction with any other offer. You can participate in offers once only. P&P and sale items are excluded from offers. These offers are not for resale or publication and only apply to personal orders with all orders being subject to acceptance under wheredidyoufindthat.com’s standard terms and conditions - orders that are considered to be commercial may be excluded from the offer.

 

Bespoke Items

Bespoke items will be sourced or commissioned especially for you. If relevant you will be asked to pay 50% of the total price on order and 50% once the item is ready to be shipped to you.  You will be sent a form detailing your order which needs to be signed and returned, at which point 50% payment will be taken.  You may cancel your order at no cost before you sign your confirmation, however, any cancellations after you have signed the confirmation will incur the additional 50% payment.

 

Payment

Payment for all non bespoke orders is at point of sale and not at point of dispatch. All prices are inclusive of VAT (where applicable) at the current rates and are correct at the time of entering the information onto the system. The total cost of your order is the price of the products ordered excluding delivery. You confirm that the credit or debit card that is being used is yours. All credit/debit cardholders are subject to validation checks and authorisation by the card issuer. If the issuer of your payment card refuses to or does not, for any reason, authorise payment to us, we will not be liable for any delay or non-delivery. We reserve the right to withdraw any products from this Website at any time and/or remove or edit any materials or content on this Website. We may refuse to process a transaction for any reason or refuse service to anyone at any time at our sole discretion. We will not be liable to you or any third party by reason of our withdrawing any product from this Website whether or not that product has been sold; To be eligible to purchase products on this Website and lawfully enter into and form contracts on this Website under English law you must:

Register by providing your real name, phone number, e-mail address, payment details and other requested information.

Stipulate a delivery address in the United Kingdom. Please note that PO box numbers, hotels and accommodation addresses are not acceptable.

Possess a valid credit or debit card issued by a bank acceptable to us.

By making an offer to buy a product, you specifically authorise us to transmit information (including any updated information) or to obtain information about you from third parties from time to time, including but not limited to, your debit or credit card number or credit reports, to authenticate your identity, to validate your credit card, to obtain an initial credit card authorisation and to authorise individual purchase transactions.

 

Delivery

Please note that larger item deliveries are sent using our specialist couriers with a one man vehicle. Please ensure that someone is on hand to assist the driver if your box is large or would need two people to lift. These deliveries are scheduled in with you so you will know when the couriers will be arriving. Deliveries are to the front door only.

Before accepting your item/s from the courier please thoroughly check the contents of the box/es before signing for the goods, even if the boxes appear to be in perfect condition. Please ensure that you clearly mark the couriers paperwork with a description of the problem.  Once items are accepted we will not be held responsible for any loss or damage whatsoever. Signing for items “unchecked” is not acceptable.

 

Delivery Within Great Britain

Smaller items will usually be dispatched within 3 to 5 working days.

For larger items please allow approximately 14 days for delivery, we will let you  know which day your delivery will arrive and then again on the morning of delivery to advise you whether it will be an AM or PM slot.

International Shipping

Larger items orders need more specialist care and handling and are despatched through our international couriers. The service is door to door and you will be contacted by your local Customs department when your item has landed prior to delivery to your home, so you will know exactly when to expect it. Please don’t forget that there will be an import tax paid locally in most countries/states which will vary for your items. Before you make your purchase contact us by email, enquiries@wheredidyoufindthat.com because of the different time zones, confirming your zip code or address and we will provide you with a price for shipping prior to your purchase. Alternatively you can make your purchase online  and we will contact you to add the shipping costs before confirmation and dispatch of your order.

 

Measurements

Please make sure you measure correctly before placing a bespoke furniture order. Consider staircases, doorways or any tight spaces used as access points. If you need to return an item of furniture, the original delivery charge will be deducted from any refund or exchange value.

 

Your Right to Cancel

You may normally cancel your order (once accepted by us) for any reason up to the point of dispatch. If you do cancel your order within this time any payments made by you will be refunded in full within 30 days. It is not possible to cancel special one off commissioned or bespoke orders once production has started and you will be charged in full.

 

Items Out of Stock

As many of our products are one off items it is possible that something in stock may become out of stock immediately if purchased, but the stock check is done every 24 hours.  If there is more than one order for a particular product in that time then it will be sold to whoever made the order first.  Any payment will be refunded in full to the other parties who purchased the item in question.  Occasionally items can be re-sourced from specialist suppliers we do use so if you would like to enquire about this please contact us on enquiries@wheredidyoufindthat.com and if it is possible we can also advise you of a future availability date.

Should an item be out of stock then you will be advised as soon as we receive your order and you will obviously have the right to cancel with a full and immediate refund.

 

Postal Discounts

A postal discount will be given when multiple items are purchased and dispatched together where possible. Each discount will be unique to the weight and size of good s purchased, please contact us on enquiries@wheredidyoufindthat.com advising us of the items you are interested in and we will confirm the total delivery cost.

 

Returns

While we hope that you’re always delighted with your order, we understand that there are occasions you may want to return items. If this is the case please contact us on 0845 890 4457 or email enquiries@wheredidyoufindthat.com

Items must be returned within 8 days of receipt to qualify for a refund – specifically made bespoke items cannot be returned.  Please ensure all items are wrapped securely and we recommend that you use insured registered delivery and keep the receipt. We cannot accept liability for goods lost or damaged in transit. We ask that you return the item unused, and in its original packaging and in perfect condition.  If this is not the case and the item/s are damaged we will not be able to refund you.

We cannot be responsible for interest charges made by your credit card company whilst waiting for returns to be refunded to your card.

In the unlikely event that your purchase is received damaged then we will, of course, replace, exchange or refund including the cost of the courier.
